Acceptance of Terms
Description of the Service
9ping Analytics is a privacy-first web analytics tool that lets you measure traffic to your own websites by embedding a small JavaScript tag, with all data stored in your own database on infrastructure that you control.
The software is provided free of charge for self-hosting, and because it is self-hostable, you act as the data controller for any visitor data your instance collects, not the author of the software.
The software is designed to collect coarse, privacy-respecting measurements such as page views, referrers and traffic sources, anonymized IP addresses, and UA-derived browser and device information, and it does not use third-party advertising cookies, does not fingerprint visitors, and does not sell or share data.
Eligibility and Accounts
You must have the legal capacity to enter into these Terms and to operate a web analytics service in your jurisdiction in order to use the software.
You are responsible for your dashboard account and for all activity that occurs under it, including safeguarding your username, password, API key, two-factor authentication, and one-time recovery codes.
Two-factor authentication is mandatory, and you are responsible for keeping your TOTP device and recovery codes safe; the operator cannot recover an account whose credentials and recovery codes are lost.
Acceptable Use
You may only deploy the measurement tag on websites that you own or are otherwise authorized to track, and you must not use the software to collect data from sites or visitors without proper authorization.
You are solely responsible for complying with all privacy and data-protection laws applicable to you and your visitors, including providing any required notices, disclosures, or consent mechanisms and maintaining your own privacy policy.
You must disclose your use of analytics to your own visitors as required by law and must not use the software for unlawful surveillance.
You must not use the software to track sensitive categories of data unlawfully, to send custom events containing data you are not permitted to process, or to attempt to re-identify visitors.
You must not use the software for any unlawful purpose or in any manner that infringes the rights of others or violates applicable law.
API and Fair Use
The API and bulk or site-group features are provided for reasonable, good-faith use, and you must not abuse, overload, or attempt to circumvent rate limits or other protective controls.
You must not use automated means to place an unreasonable load on an instance, interfere with its normal operation, or degrade the service for others.
Intellectual Property and Open Use
9ping Analytics is provided for open, self-hosted use under the license terms distributed with the software, and your rights to use, modify, and redistribute it are governed by that license.
All trademarks, names, and branding associated with 9ping Analytics remain the property of their respective owners, and these Terms grant you no rights to them beyond what the applicable license expressly permits.
Third-Party Sites and Services
Disclaimer of Warranties
The software is provided "AS IS" and "AS AVAILABLE", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
The author does not warrant that the software will be uninterrupted, error-free, or secure, or that the measurements it produces will be complete or accurate, and you use it at your own risk.
Limitation of Liability
To the maximum extent permitted by applicable law, the author of the software shall not be liable for any indirect, incidental, special, consequential, or exemplary damages, or for any loss of data, profits, or goodwill, arising out of or relating to your use of the software.
Because the software is self-hosted and provided free of charge, you are solely responsible for your instance, the data it collects, your compliance obligations, and any claims arising from your operation of it.
Suspension and Termination
The operator of an instance may suspend or terminate access to that instance, including for abuse, security risks, or violation of these Terms or applicable law.
You may stop using the software at any time by removing the measurement tag from your websites and uninstalling your instance, and provisions that by their nature should survive termination will continue to apply.
Modifications to the Service and Terms
The software and these Terms may be updated from time to time, and changes take effect when the updated software or Terms are published.
Your continued use of the software after changes are published constitutes acceptance of the revised Terms.
